It's the end of the year, and times are busy, and besides that, LSR has had a hard time facing all the news.

The Hate Rally

We start again with the Dark Side
The dark, disgusting, racist, wretched, filthy, fetid side.

Hair Hitler met two goals by setting up shop at Madison Square Garden on Sunday. One, he got a vanity piece checked off his bucket list by performing at the self-dubbed, "World's Most Famous Arena" right in his own home town.

And two, he got a his very own Nazi rally, just like the one held there in 1939.

Buckle in; there's a lot to unpack. Many alarm bells went off.

RACIST ALARM
DonOld's opening act, "comedian" Tony Hinchcliffe, set the tone with his disgusting "jokes."
 
“I don’t know if you guys know this, but there’s literally a floating island of garbage in the middle of the ocean right now. I think it’s called Puerto Rico."

Hinchcliffe "joked" a little later: "These Latinos, they love making babies, too. Just know that they do. There’s no pulling out. They don’t do that. They come inside, just like they did to our country."

W.T.A.F.

Tucker Carlson's charm came through during his speech, saying that Harris is “the first Samoan, Malaysian, low IQ” presidential nominee.

Sid Rosenberg, a right-wing radio idiot, commented, "I just got back from Israel … and they go, 'Sid, you want to speak at this MSG thing? I go, 'Sure. Out of character for me to speak at a Nazi rally. I was just in Israel.' But I took the gig."

MISOGYNISTIC ALARM
Literal garbageman and cocaine trafficker David Rem waved a crucifix around and called Harris "the Antichrist" and "the devil."

Billionaire and fraudster Grant Cardone told the crowd that Harris "and her pimp handlers will destroy our country."

Sid Rosenberg also spat out an insult about Hilary Clinton, saying about her and Democrats in general, "She is some sick bastard, that Hillary Clinton, huh? What a sick son of a bitch. The whole party — a bunch of degenerates. Jew-haters and lowlifes, every one of them." Later Rosenberg talked about "the fucking illegals."

Rosenberg also talked about Travis Kelce, who is in a relationship with Taylor Swift: he "might be the next O.J. Simpson." Odious.

The company you keep. These are the people that are ok with 🚼 becoming president. I am not ok with them.

AUTHORITARIAN ALARM
His Infancy continued his same old lines about immigration. He has been upping the ante, and repeated a line he's been using that he would call for "the death penalty for any migrant that kills an American citizen or a law enforcement officer." And you wouldn't even wait for a trial, now would you, Hair Furher?

The extremely weird Hulk Hogan did his extremely weird shirt-ripping thing. Ok, whatever. He said, "I don’t see no stinking Nazis in here. I don’t see no stinking domestic terrorists in here." Nice use of the double negative, Hulky. The place was filled with 'em, after all.

Fucker Carlson invoked the "Great Replacement Theory" when he said, "People know in a country that has been taken over by a leadership class that actually despises them and their values and their history and their culture and their customs, really hates them to the point that it's trying to replace them. They know someone who actually has affection for them and that's Donald Trump. And it’s requited.”

And the absolute pond scum shaped into human form, Stephen Miller, echoed that sentiment when he said, "America is for Americans and Americans only." Can you guess who said, "Germany is for Germans only" about 80 years ago? Yes, that dude. The slogan "Nur fΓΌr Deutsche" – "Only for Germans" – was used on signs and placards throughout Germany from 1939 until Germany was defeated in 1945. 

"Our little secret"
Eric's alleged dad said in reference to House Speaker Mike Johnson, "We gotta get the congressmen elected and we gotta get the senators elected. We can take the Senate pretty easily, and I think with our little secret we are gonna do really well with the House. Our little secret is having a big impact. He and I have a little secret – we will tell you what it is when the race is over."

He thought he was being coy, but he showed his hand. He's alluding to a sinister plan to contest a potential loss if the Republicans have the majority in the House.

OK, resisters, VOTE downballot! The Dems need to regain the House – and keep the Senate for that matter. Let's work to not have any issues on January 6. Or anytime.


"If he can make it here, he can make it anywhere"
That was the mood and the aim of the rally, it seemed. All his minions were touting the fact that he was able to fill Madison Square Garden in deep blue New York, assigning some magic meaning to it as if he was turning the state red. LSR's eyes rolled back so far that she could view her optic nerve. 

Even though he had the "little secret," the fact is that he didn't have one single candidate on stage with him from any of the close races for Congress, of which there are many in New York. He didn't care to truly make a political impact. His simple-minded goal was to have adoring racists hang on his every wackadoodle word.

It worked – to an extent. They started leaving after he spoke for about an hour. 


The Backlash
The backlash was swift. Democrats, fellow Republicans, Puerto Ricans, and finally the media in its growing condemnation of this shit. 

The Headlines: "offensive," "crude," "mean," "racist,"" anger," "misogyny," "ugly," "vulgar," "vitriol," orgy of fascism
then there's FAUX News:

The Apologist
Prince Smarming, JV Vance, filled his apologist role as only he would. In true bully fashion, his response was, Can't you just take a joke? He said, "Maybe it's a stupid, racist joke, maybe it's not."  (Hint: it is a stupid racist joke, you stupid racist shit!) 

Puerto Rican Celebs Speak Out
These folks have millions of followers. And they are not staying silent. 

Bad Bunny, one of the biggest superstars today who has 45.6 million Instagram followers, posted a Kamala Harris video with her remarks on Puerto Rico and the Mango Mussolini's inhumane treatment of the island's residents during hurricane disasters. With this, Bad Bunny tacitly endorsed Harris.

Puerto Ricans Ricky Martin and J Lo soon followed suit and posted the video to their Instagrams as well. Between the three of them, they have more than 300 million followers on Instagram, nearly the whole population of the United States! Yes, I know there is overlap in their followers, but still!

The Puerto Rican singer of "Despacito," Luis Fonsi, also took to Instagram, posting the video clip of Hinchcliffe’s "joke" about Puerto Rico and commented, "Are you serious?" And he added, "I understand comedy, I'm a big fan of it. I love roasts, trust me, I get it, BUT... this is far from comedy. We are not ok with this constant hate. It's been made abundantly clear that these people have no respect for us and yet they want our vote."

Democrats
  • Kamala Harris called it "nonsense" and said it "fans the fuel of hate and division." 
  • AOC called it a "hate rally."
  • Former 45 communications director for nine days, Anthony Scaramucci (I put him in the Democrat column; he's been both), called it "race baiting."
  • Puerto Rican Rep. Nydia Velazquez (D-N.Y.) spoke out strongly, saying the comments were "a slap in the face to every Puerto Rican in New York and the five million Puerto Ricans in the mainland."
  • The DNC projected messages on the exterior of the building before and during the rally, some of them reading, "Trump praised Hitler," "Trump = Unhinged," and "Trump = Unfit."
  • And many other Democrats. Here is a montage, from, of all sources, Fox News. (I had trouble embedding it; if it doesn't play, click this link)

The Puerto Rican Voters
The fallout from Puerto Rican voters, especially in Pennsylvania, where there is a large Puerto Rican population, was swift and strong. They are angry and they are talking about it. Way to get out the vote, Dumpy!

Republicans
Republicans tried hard to paddle their rowboats hard away from this shitshow. Some of the reactions:

Florida Republicans especially called it out. Sen. Rick Scott (R-Fla.) tweeted, "This joke bombed for a reason. It's not funny and it's not true." 

Cuban-American Rep. MarΓ­a Elvira Salazar (R-Fla.) posted on X: "Disgusted by Tony Hinchcliffe’s racist comment calling Puerto Rico a 'floating island of garbage.' This rhetoric does not reflect GOP values. Puerto Rico sent 48,000+ soldiers to Vietnam, with over 345 Purple Hearts awarded. This bravery deserves respect. Educate yourself!"

Another Cuban-American Rep. Carlos Gimenez (R-Fla.), tweeted that the comments were "completely classless & in poor taste" and "definitely doesn't reflect my values."

Rep. Anthony D'Esposito (R-N.Y.) tweeted that he is "proud to be Puerto Rican. The only thing that's 'garbage' was a bad comedy set. Stay on message." 

The campaign itself tried to distance itself by saying, "This joke does not reflect the views of President Trump or the campaign." Yeah, no. It really does, though. It really does.

Just to remind you of McDiaper's disdain for Puerto Rico. He withheld aid to the island after Hurricane Maria (and insulted them by throwing paper towels instead); he mocked their accent; he called it "dirty" and wanted to trade it for Greenland; he showed – or maybe feigned – his ignorance of where PR is located (hint: it's not in "a big ocean, a really, really big ocean"); and he disowned them or didn't even understand that he is their president (side note: he clearly didn't know he was president of the U.S. Virgin Islands).

There are millions of Puerto Ricans in the mainland United States and hundreds of thousands in swing states. I hope they, and all the other Latinos in the United States, pay attention, get out their chanclas, and vote!

Side note: I know there are lots of issues facing the next Congress, but we really need to push for PR to become a state. They need a voice! 

If this is his "closing argument" one week before the election, we get it.

Black women raise their voices!
There were a couple of stirring moments at recent Harris rallies this week.

Beyonce met up with Kamala in her hometown of Houston to give this moving introduction.

And the amazing and wonderful Michelle Obama campaigned with Harris in "Kamalazoo," Michigan on Sunday. Her whole speech is worth the watch, but when she talked about women's issues and talked directly to the men, it was especially good! Here is the whole speech, and her remarks on women's safety starts at about 21:40. 

 


More about the Washington Post non-endorsement
The non-endorsement that Jeff Bezos forced upon his Washington Post editorial staff came hours before his employees from his government-contracted space company Blue Origin met with King Ketchup. Suuuuper stinky, people. Super duper stinky. 

Over 200,000 WaPo subscribers – about 8% of their circulation – have cancelled their digital subscriptions

Former Executive Editor of the Washington Post Marty Baron put it well on NPR's Morning Edition
"If this decision had been made three years ago, two years ago, maybe even a year ago, that would've been fine. It's a certainly reasonable decision. But this was made within a couple of weeks of the election, and there was no substantive serious deliberation with the editorial board of the paper. It was clearly made for other reasons, not for reasons of high principle."
The Los Angeles Times and the Washington Post's non-endorsements are being called "anticipatory obedience," which is a cog in the Fascism machine. The Colombia Journalism Review dove into this subject just a few weeks ago. The cogs have been turning, it seems, for a while now. 

Trust in the two newspapers may never again be rebuilt. Not only that it was done, but how it was done (at the very last minute) and who did it (the billionaire owners) may have broken the public's trust completely. 

The New York Times's editorial board stuck it to them. Here is their Sunday Opinion Section's front page.


The online version of the headline was just as powerful. Read the essay.

A catch up on a couple things from the last couple weeks

Arlington National Cemetery assault
A new detail came out about that illegal and immoral event at Arlington National Cemetery where DonOld used the hallowed grounds for a campaign video. In the heavily redacted report that was released as a result of a lawsuit, it says that the campaign staffer put "both hands" on the Army's Arlington employee. Police called it a "simple assault."

The Kavanaugh investigation was worse than we thought
A column from Robin Abcarian, a true gem of the Los Angeles Times, and one that I will miss since I cancelled my subscriptionoutlined the "supplemental investigation" by the FBI after Christine Blasey Ford's allegations. She shows that the investigation was controlled by the Mushroom Man, and it was a complete sham. They did just enough to make it appear to be conducting an investigation, but it was just show. It worked to cement Kavanaugh's confirmation.

Once in a while, I still ask my Members of Congress to work to impeach the bastard.

George Conway's heroism
George Conway went on this podcast to describe how he went from a Drumpf supporter to one of the most vocal critics on the right. He helped found The Lincoln Project, which has been running anti-Dumpty ads for years, and his new PsychoPAC, both of which help educate and motivate voters to turn away from him. Conway really is brilliant, and he is an American hero. He cares. Deeply.

Madam President!


Joe went and done it. He suspended his candidacy for president. 

It was a bittersweet moment. I, like many of you, went through a gamut of emotions on Sunday. First was excitement for the new possibilities. A woman for president!? Yes, please!! Then, sadness for Joe and wishing that it was different for him. 

A wave of gratitude also hit. He's been a public servant his whole gol-darn life. He was the youngest sitting senator when he was took office in 1973, and now he is the oldest president. He's given immeasurably in service of our country. This latest act is maybe the most consequential of his career. He was selfless in his decision to step aside and hand over the reigns to a younger candidate. This is what it means to have love for your country. Joe Biden is a true patriot.

He has endorsed his Vice President, Kamala Harris. Here is his letter announcing his decision. Incredibly, he informed his staff only one minute before the rest of the nation found out on Sunday afternoon. 



The world feels electric now! It feels like Christmas Eve!

Overnight, the country's blue excitedly rallied around Ms. Harris and embraced her candidacy. They also threw money at her. In the 24 hours since Joe's announcement, her campaign raised $81 million, $47 million in just the first seven hours.

Nearly every top Democrat has endorsed her, and so far there hasn't been any noise from any other potential candidate. 

What if someone else throws their hat in the ring?
It would make for an old fashioned open convention, just like the old days. 

Biden released his delegates and endorsed Harris, but the 3,900 delegates can vote how they want to. Former House Speaker Nancy Pelosi initially declined to endorse Harris and said she preferred an open convention, but soon after, she reversed and announced her endorsement for Harris.

Other Democratic leaders have also endorsed her, including Michigan Gov. Gretchen Whitmer and California Gov. Gavin Newsom, both of whom had been thought to be potential opponents. 

It makes sense for Harris to be the Democratic candidate. She is already on the ticket. We chose her to step into the office of president should something happen to Biden. She makes the absolute most sense for winning the candidacy. 

True, it would be more democratic to have some others run and have a raucous convention (and arguably, more fun!). But it is exciting to have the party coalesce around a candidate and get this thing going! We have important work to do in the next 100 days, Kamala is a great candidate, and we are ready!

Breaking: the point has become moot since I wrote the above; Kamala Harris has enough delegate support to nominate her next month!

What about a Vice President pick?
OOOh another intriguing, exciting question. 

Politically, it would be good to balance the ticket, e.g., a white male from a swing state. But there are many men and women, and many people of color who are supremely qualified and I hate that we have to think like that. Who are some of the names being thrown about?

California Gov. Gavin Newsom
Known for: Governor since 2019; has been a strong progressive voice; debated Florida Gov. Ron DeSantis and visited many red states. There is a pesky part of the 12th Amendment that prohibits electoral votes to go to president and vice president candidates who come from the same state. If he were selected as VP, one of them would have to change states of residence to avoid that stickiness.

Pennsylvania Gov. Josh Shapiro
Known for: Winning the governorship in a landslide in 2022 against an election denier; handling the tragedy of the recent shooting at a T**** rally gracefully when he said this about the man who was killed: “Corey was a girl dad. Corey was a firefighter. Corey went to church every Sunday. Corey loved his community. And most especially, Corey loved his family.”

Gov. Andy Beshear of Kentucky
Known for: Popular governor in a deeply red state; won the governorship in a state that T**** won by 25 points in 2020.

Gov. Roy Cooper of North Carolina 
Known for: Narrowly winning the 2016 election in this pivotal swing state; pushing back against a Republican state legislature; won in opposition to the "bathroom bill" that prevented people from using the restroom that they felt most comfortable in; expanded Medicaid in North Carolina.

Sen. Mark Kelly of Arizona
Known for: Serving in the Senate since 2020; was a Navy combat pilot and astronaut; husband of Rep. Gabby Giffords, who was shot at a constituent event in 2011; has name recognition and is from an important swing state. 

Michigan Gov. Gretchen Whitmer
Known for: Won re-election in an 16-elector swing state by 10 points in 2022. Has pushed for important progressive issues, from women's reproductive rights to expanding access to healthcare, to improving water quality in Michigan and improving infrastructure. Her decisions regarding Covid precautions made her the target of a kidnapping plot in 2020.

Illinois Gov. JB Pritzker
Known for: Governor since 2018, has been pushing for gun laws, reproductive rights, and signed legislation prohibiting book banning. Can self-fund a campaign, as he is heir to the Hyatt hotel conglomerate.

Gov. Wes Moore of Maryland
Known for: Maryland’s first Black governor; combat veteran; at age 45, already a New York Times bestselling author, Rhodes Scholar, Army combat veteran, and former CEO of the Robin Hood foundation, an anti-poverty organization.

Secretary of Transportation Pete Buttigieg
Known for: Presidential bid in 2020 after holding the office of mayor of South Bend, Indiana; first openly gay man to run for president; first openly LGBTQ person to serve in a cabinet position; has served as Sec. of Transportation under Joe Biden; articulate and intelligent; good name recognition. Would you have been able to name the secretary of transportation of any other administration?

Georgia Sen. Raphael Warnock
Known for: won a narrow victory in a deeply divided state; Baptist minister in the same church MLK served; before entering politics, worked toward expanding Medicaid and expanding voter registration in Georgia.

So many solid choices! Read more about them in the Los Angeles Times, CNN, or Politico.

If I were on Ms. Harris's advisory committee, I would steer her toward Mark Kelly and Mayor Pete. I adore Mayor Pete! He is intelligent and well-spoken and would absolutely trounce JD Vance in a debate!

What about the other guy?
He is in hot water! He has to pivot hard to campaign against this fresh face. It's his worst nightmare: a strong, articulate woman of color who can handle whiny men (I'm looking at you, Brett Kavanaugh) with fierce assurance. He's now the oldest man to ever run for president. He's stuck with an unlikable boot-licker of a VP. And he is who he is; he is a turd.

But this isn't about him. 

This is about Kamala! Yayyyy!

The Sword of Damocles

But is it over T****'s head or ours?

We're reaching the point in our history that courts are busting open with T**** cases left and right, and more than one of these cases could have major implications to the future of our country. Between the lawsuits themselves and motions and appeals, a lot has been happening. We've got a lot to dive into. Let's take a peek at the seven court cases that have been filing up our newsfeed. SEVEN!



Case #1. That f∩¢*(g Constitution. The Supreme Court heard arguments about eligibility based on the issue brought up by Section Three of the Fourteenth Amendment of the United States Constitution, which apparently disqualifies T**** from holding office. You remember Section Three. It reads:
No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.
Colorado and Maine have ruled that he is ineligible to appear on their ballots, and other states have the issue in limbo, pending the decision from the Supreme Court. 

Before they met to hear arguments in the Colorado case, I thought that SCOTUS may decide in T****'s favor in one of these ways:
1. Section Three prevents him from holding office not running for office. OK good, but what happens if he is elected? Do we bar the door to the White House?
2. The Section does not explicitly name "president" as an officeholder worthy of disqualification, or the holder of the office of president is not an "officer" of the United States. Sure, go ahead - he is eligible to lead the nation even though he failed to protect the very Constitution that he wants to protect him.
3. He didn't commit insurrection nor did he aid and abet those who did. There has been no legal finding that he actually committed insurrection. Even though the statute does not say he has to be convicted, SCOTUS may rule that it is necessary before he can be disqualified. A majority of both houses of the United States Congress said he did in when the House indicted him for "Incitement of Insurrection." That should count in the effort to send him packing!

Seems, though, that this wasn't how it would go. By some of the questioning, there may be other justifications to not disqualify him: one is the states' differing treatment of candidate T****, and by extension, candidate Biden.

Justice Kagan: "Why should a single state have the ability to make this determination, not only for their own citizens but for the rest of the nation? ...That seems quite extraordinary, doesn’t it?"

Chief Justice Roberts chimed in: "Surely there will be disqualification proceedings on the other side. I would expect … a goodly number of states will say, whoever the Democratic candidate is, 'You’re off the ballot.'"

 So, #4. It's not a state's place to decide the issue. Um, are you nine missing the point? Duh, you guys. YOU are to rule on the Law of the Land. The whole land. That's why this case is being brought to you. The Constitution applies to all the states, dum-dums! YOU are the ones deciding for the whole country. Isn't this your job?

Justice Alito seemed to be concerned with what will happen in the states after the decision: "There will be conflicts in decisions among the states, that different states will disqualify different candidates, but I -- I'm not getting a whole lot of help from you about how this would not be an unmanageable situation." 

Justice Alito, did you think about how different states will react to your decision to rip healthcare rights away from women? How about back in 2022 when you said, "We cannot allow our decisions to be affected by any extraneous influences such as concern about the public’s reaction to our work. We do not pretend to know how our political system or society will respond to today’s decision overruling Roe and Casey. And even if we could foresee what will happen, we would have no authority to let that knowledge influence our decision."

Or, #5 reason to not disqualify him. By Kavaw-nawwww's and Barrett's questions, SCOTUS may invoke a 1869 case which suggested that an act of Congress was needed to enforce this type of disqualification. But the Section does not say it's Congress's place. The whole point is that it is self-executing, like the other qualifiers such as being a natural-born citizen or being 35 years old. 

Or they may find some other nitpicky reason to keep him on and avoid having to be held accountable to the Constitution. By hook or by crook, they'll find a way to let him be.

It's a fascinating moment in history, but I'm supremely pessimistic that they will disqualify him. 

Indeed, the pundits agree, most indicate that the justices are leaning toward not disqualifying him. Sadly I was not able to listen to the proceedings myself, but here is the transcript, and we have lots of smart people to analyze. 

After reading some analyses, it seems like the justices only touched on the most salient aspects of the Section, but focused on the states aspect and the Congress aspect. They didn't really delve too deeply into the question of whether the president is an "officer" or that he actually committed insurrection. 

Yanno, a lightbulb went off for me: I now realize that SCOTUS can say and do anything they want to. They don't have to follow the Constitution at all. They can just make it up as they go along; after all they are the Supreme Court of the United States. Sadly, it's looking like they are just another political body.

I predict that the justices will be unanimous and will craft a carefully worded decision to present a united fraud, I mean front. A decision is expected within a few weeks.

Case #2. $88 million dollars, baby! Pay up! E. Jean Carroll won a second defamation award. In May 2023 she had been awarded $5 million in her defamation suit against T**** after he disparaged her and damaged her reputation. She had written a book detailing the sexual assault he committed against her in the '90s. And he didn't like that. So he started talking shit about her. Asshole

After the first trial for defamation where he lost to the tune of $5 mil, he just couldn't stop his vile insults and disparagements of her character. She sued him again. This time, the jury awarded her a whopping $83 million, which included $65 million in punitive damages! So far, it has shut him up. But she is willing to sue again. It must be killing him to hold his tongue ...errr, his thumbs.

Case #3. The other civil trial: The nation has been waiting with bated breath for Judge Engoran to rule on what punitive damages he will mete out for the massive fraud that T**** and his business committed in the state of New York. Engoron decided there was ample evidence of fraud before the trial even started; the trial was simply to decide what the penalty would be. Speculation is that he will strip the business license from the T**** Organization and order $350 million in restitution. Ooooh dem millions are slipping away.

There was a bit o' drama when it was revealed that one of the witnesses may have committed purjury during testimony. And this revelation may be why Judge Engoron has not ruled yet (he had said he'd have a ruling by January 31, and here we are 10 days later). It turns out that Allen Weisselberg, the former chief financial officer of the T**** Organization, is working out a plea deal with the Manhattan district attorney's office for his perjury during the Engoran trial.... before that outcome has made itself known. What the what?!

Case #4. Immunity forever and ever? No, sir. Not in the U.S.A! T**** has claimed that presidential immunity, which shields a sitting president from having to deal with lawsuits while leading the free world, protects him from any and all crimes he committed as president (or, in the classified documents case, after he stopped being president). He is using an absolute immunity claim to hold off the federal insurrection case against him brought by Special Prosecutor Jack Smith. A three-judge appellate panel of the U.S. Court of Appeals for the District of Columbia Circuit firmly denied his immunity claim in a strongly-worded unanimous opinion. This, after the judge overseeing his case, Tanya Chutkan, denied his claim of immunity but put the trial on pause so the appeals can move forward.

T**** plans to appeal this latest decision, of course. He may take it to the full D.C. Circuit Court or leapfrog directly to the Supreme Court. 

It was clear from their questioning last month which way the trio on the appellate panel was leaning. For example, Judge Florence Y. Pan asked, "Could a president ask SEAL Team Six to assassinate a political rival? That is an official act, an order to SEAL Team Six." T****'s attorney's didn't have a very good answer, hemming and hawing about having to be convicted in an impeachment trial first. πŸ™„ Listen to that bit of audio here.

Based on their strongly written unanimous (written per curiam, which means no primary author; they are all in full agreement) opinion, I am hopeful that the Supreme Court will decline to hear the case. If they do the right thing and let the decision stand, the federal insurrection trial (and by extension, the Georgia trial, which is also grappling with immunity, as is the federal documents case) can go forward immediately. If SCOTUS takes up the case, there will be more delays in the start of the trials, and justice may very well be denied. ("Justice delayed...." and all that).

Case #5. Darn you, Fani Willis! Every member of every prosecution team in each one of the myriad lawsuits against T**** must be impeccable in their behavior. Fani Willis, District Attorney for Fulton County, Georgia, sadly, was not impeccable. Rumors started swirling that she was embroiled in an affair with a special prosecutor that she had appointed to assist in Georgia's case against T**** which changed him for his conspiracy to lead a criminal cabal to attempt to overturn the results of the 2020 election. 

Willis finally admitted that the affair was happening, but said it will not affect her ability to work the case, blah blah blah. Conflict of interest much? You can't do this kind of shit, Fani! Shape up! Let's hope that it hasn't damaged her case against TRUMP too much. Legal experts in Slate write that it probably won't harm the case in a great way. Still, not good optics, Fani. Be better.

Case #6. The Federal Classified Documents Case: Special Counsel Jack Smith's frustration with the defendant and with the judge is growing. Smith made an unusual filing to the court a couple weeks ago. It was a routine filing, but the 64-page document apparently reads more like an opening argument for a trial. In it, he strongly rebuts T****'s falsehoods regarding the way the classified documents case unfolded. 

Smith is also becoming frustrated with Judge Aileen "Loose" Cannon. He has filed a couple filings with her, calling out some of her decisions, not the least of which was her decision to release the names of potential witnesses. It really is outrageous to expose witnesses to the Wrath of Khan't. Real harm could come to the witnesses from nut-job MAGAts. Witnesses who are just trying to do the right thing and tell the truth. Cannon should understand this abundantly. She herself has been subject to death threats from wackos. One nutter has recently been sentenced to three years.

7. The hush-money case in Manhattan may move forward given stalls in other cases. The trial is scheduled to begin on March 25. Though it had been put on the back burner so other cases could move forward, the slow wheels of justice have all but ground to a halt in some of those other cases, paving the way for this one to possibly go ahead.

The Repug Party continues to crumble. They cannot help but put their head under directly under T****'s boot. You have probably seen the news about the border deal gone ka-blooey. For ages the MAGAts have been calling for a border bill to manage the crisis at the southern border. A deal was hashed out in the Senate in a bipartisan way, and the bill passed the Senate. 

Here we had a bipartisan bill with wide support, and President Biden was warming up his pen to sign. But the Orange Menace struck again: he doesn't want there to be any cooperation with the Left, so he instructed House Speaker Mike Johnson to kill the bill. So freaking frustrating.

That fake T**** auto workers "union" event in Michigan back in September? Turns out he paid $20,000 for the privilege of duping The People by hiring non-union folks to pretend to be union members at the bogus event. Rachel Maddow can tell you more. 

There's more evidence of T****'s neurological disorder, such as mixing up Nancy Pelosi and rival presidential candidate Nikki Haley. But that's not new news.


And Biden's failings. Robert Hur, the special prosecutor who looked at Biden's mishandling of classified documents, released his report and did not find a prosecutable case. Hur did call into question Biden's memory, though, and those comments overshadowed anything else from the report. Biden was not happy with Hur's opinions on his memory, and many prosecutors, even conservatives, agree he crossed the line. The comments are indeed potentially politically damaging.

I don't want to be agist. People of advanced age can and do fill complex roles with heavy cognitive loads. The fact is that Biden's age is a political problem, even before this. People are concerned about his age. Yes, T**** is old, too, and definitely cognitive impaired, and he's not much younger that Biden. But somehow, that stink has not stuck on him for the MAGA crowd, but it's sticking like crazy on Biden. Mini Racker in Time Magazine has actually discussed that for us, suggesting that in large part, it's all about appearances.

Let's just say Biden is forgetful. OK, but he is still a solid president. He has been getting things done (the infrastructure bill not the least of it!). The almighty American economy is booming. He's a strong leader. Even with some memory issues and his advancing age, he poses nowhere near the risk to our nation that T****'s return to the Whitewash House would dish out. There are much bigger issues. We need to reelect him.

THE MAGAt crowd is losing their shit over Taylor Swift, her boyfriend in the NFL, and what they see as a conspiracy to *gasp* influence the election by *clutching pearls* getting more than a few of her millions of fans to register to vote. Here we are, it is Super Bowl Sunday, and she'll be in the stands cheering and being her subversive self. They really hate powerful women, don't they? And they really, really hate people who vote!

We've had one more stumble into the yawning rabbit hole of our Nation's demise.

It's really hard to write this. History was made yesterday, when the 115th Senate voted to confirm Judge Brett Kavenaugh as a Justice on the Supreme Court of the United States.

And to every decision, there are consequences. One hundred people, elected to represent our interests, sat and made a decision. And that decision has consequences. Some are big, some are small, but the repercussions of that decision will be lasting.

I have been filled with anxiety and dread for several weeks, and now the reality is that this man is on the highest court. I look at my one-year-old granddaughter, and I fear the consequences that she will face because of it  -- through her whole life. That's a sobering thought.

So what do we take away from the last couple weeks?  (Caution: Debbie Downer stands up below, but keep reading; Hopeful Little Sister Resister comes back!)


Consequences to every last one of us:

1. Our Democracy has taken a astronomical hit. "Due Process" is a concept that is dead. Doing the Right Thing = dead. Compassion = dead. The nation is not only deeply divided, which in itself is not a bad thing, but the very fabric of our Nation is tearing. The principles which have guided us for 241 years are crumpled.

2. We've reached a new low in our discourse. A new level of incivility is upon the land. "Incivility" is an understatement. It was sickening to witness what we've witnessed in the last week or so. I could not believe a grown man acting so childish and entitled, challenging and mocking Senators of the United States.

We have come to expect this sickening behavior from SCROTUS. His comments at a rally in Mississippi, mocking Dr. Ford and her testimony, was a new low, even for him. But it's not unexpected. And that fact in itself is incredibly sad.

We have come to expect it from the entitled, elite white old men who lord over the land. It was shocking, but not surprising, when Sen. Lindsey Graham (R-SC), made Brett the victim, and made a spectacle of himself calling the process "Hell."

But the person who wants to be placed to the highest court? Speaking to Senators of the United States of America? Sitting before them to ask them to bestow upon him the honor of sitting on the highest bench? Asking their favor to judge his fitness?

Brett sneered to Sen. Kolbucher (D-MN), "Have you ever blacked out?"  Not once but TWICE.  And to Sen. Whitehouse (D-RI), “Do you like beer, senator? What do you like to drink?”  His graceless questions may have been awkward attempts at filibustering each Senator's five minutes, but it showed his true colors as a boorish, contemptible man-child. Not fit for the highest court in the land. Not fit even to have dinner in my home.

His defense of this angry, sniveling, undisciplined, undignified testimony?  "Look at what you made me do." Another gas-lighting, abusive man in power. Great.

3.  Another branch of our Tri-Corner Government has been dirtied. The one that seemed to be standing firm with nearly unblemished reputation. The Supreme Court, once the hallowed ground for the most elevated, thoughtful, even-tempered, and fair-minded individuals in whose trust we place to hand down far-reaching decisions and to be an integral part of our Nation's checks and balances:  Sullied. Credibility vanished.

Many in the Judge Business advised the Senate not to confirm. The American Bar Association warned not to confirm in a letter sent to the Senate Judicial Committee.

Quite alarmingly, judges on the 10th Circuit Court of Appeals, D.C, Circuit, where Justice (I shudder to use that word) Kavenaugh sat for 12 years, sent more than a dozen letters to Chief Justice Roberts, complaining of judicial misconduct on the part of Brett Kavenaugh. Justice Roberts did not act on the complaints, and now they are forever buried.

And perhaps most dismaying, Justice Kagan has grave concerns about this appointment and what in means for our Nation.  She laments, "It's an incredibly important thing for the court to guard is this reputation of being impartial, being neutral and not being simply extension of a terribly polarizing process." She fears that the Court will lose legitimacy. I've wondered over the last week what the other Justices think of him and the trajectory of the Court. Perhaps someday we'll hear from more of them.

Never in our history has there been so many misgivings about a Supreme Court nominee, from top to bottom, in this country. The Supreme Court is deeply wounded.

Consequences to our children:

Girls' and women's beliefs that they don't count, that they won't be believed, that there are no consequences to their attackers, are being cemented.

Boys' and men's beliefs that women don't count, that no one will believe them, that they have no consequences to their actions, are being cemented.


Consequences to the Midterms and Beyond:

Here's where we have some positives.

Many pundits have speculated that this issue has motivated the Republican base as it has the Democrat base. I doubt it. And if it has, it has only fired up the basest of the base (and I do mean that in the Shakespearian meaning of base (base (adjective): not showing any honour and having no morals)). I want to believe that most Republican citizens, in their hearts, believe Christine Blasey Ford and do not approve of this man's behavior at his Senate hearing. That's what is in my heart.

And for the rest, they may cheer their Misogynistic Cheeto, but I really don't think they are as fired up and mobilized as those on the Center on over to the Left.

So, the consequences for the Republicans: they are going to get demolished at the polls in a few weeks, and for years to come. And specifically, consequences for Susan Collins. Shortly after Kavenaugh was nominated, there came a kickstarter-type campaign to raise money for Collins's eventual opponent, to be collected from donors only if she chose to vote to confirm him. She voted yes, so her as-yet-unnamed 2020 opponent has a chest of over 3 million dollars already! (Susan Rice yesterday gave an indication that she may jump in the race.)

This article is great. It outlines that Republicans may have won the battle, but Democrats will definitely win the war.

The numbers fluctuate, but in general, there are more Democrats than Republicans, and Gallup reports that as of October, 2107, at least, more of those who identify as independent lean left than lean right. From Wikipedia:
As of October 2017, Gallup polling found that 31% of Americans identified as Democrat, 24% identified as Republican, and 42% as Independent. Additionally, polling showed that 46% are either "Democrats or Democratic leaners" and 39% are either "Republicans or Republican leaners" when Independents are asked "do you lean more to the Democratic Party or the Republican Party?"
And nearly every single one of them is fired up.

Change happens when people get angry. People in the streets ended Vietnam. People in the streets furthered Civil Rights. People in the streets WILL stand up and right our course. I'm sure of it. It'll take time to undo the damages, but it will happen. We need to work together. Next stop: November 6.

And when they are in power again, David Atkins of the Washington Monthly advises that they channel their inner Mitch McConnell and push their agendas hard. Change will happen. Change must happen.


Consequences to our knowledge base: 

Ok, I'm stretching it but I need to find more positives. People are learning. Knowledge is good. We're learning more about sexual assault and its effects. We're learning about the concept of "innocent until proven guilty" (Hint: it's a legal premise protecting the accused in a criminal court. It does not apply to job applicants). We're learning about brain science and the way memories are laid down in our brain. Dr. Ford herself explained a little about the neurology of trauma memories being stored in the hippocampus. (Which by the way, if any one of those Senators can remember what they were doing at 8:46am EDT on September 11, 2001, but not recall what they had for breakfast that morning, they are living proof of the kind of episodic traumatic memory that Dr. Ford described).


Consequences to our Nations Laws:

There are real fears that Kavenaugh's inclusion on the Court will usher in overturning many of our treasured laws. The biggest fear is that Roe v Wade will be overturned and individual States will once again decide if abortion is to remain legal or not. There is also fear that Kavenaugh will be the deciding factor in overturning the Affordable Care Act, affirmative action, and even curtailing the Mueller investigation and giving life to the notion to the President is above the law. Reeeealllly scary shit.

Though the Court is now more conservative than ever, we have to remember that Kavenaugh is but one voice among nine. He will not be single-handedly changing laws. My heart wants to believe that the process will still work. (please please please let the process work)  And we still have the Notorious RBG!  Please stay alive, Ruth!
